Please read these Terms of Service ("Terms") carefully before using the services provided by FSVPServices.com. By accessing or using our website, services, or engaging with us as a client, you agree to be bound by these Terms.

1. Scope of Services

FSVPServices.com provides compliance support services including, but not limited to:

  • Foreign Supplier Verification Program (FSVP) Agent and Qualified Individual services
  • U.S. FDA U.S. Agent representation
  • FDA registration assistance
  • Compliance documentation management
  • Regulatory training and consulting
  • All services are rendered under the management and direction of Consultare Inc. Group, A Compliance Company.

    2. Eligibility

    By engaging our services, you affirm that you:

  • Are at least 18 years old or of legal age to enter into a binding agreement
  • Are authorized to act on behalf of the business entity you represent
  • Operate a business intending to import or export food, supplements, or similar regulated goods into the United States
  • 3. Client Responsibilities

    You agree to:

  • Provide accurate and complete business, supplier, and product information
  • Cooperate in providing required documentation, records, and declarations necessary for FDA compliance
  • Inform FSVPServices.com of any regulatory updates, inspections, or enforcement actions related to your company or products
  • Maintain active and timely communication with our team to ensure your services remain in good standing
  • 4. Fees and Payment

    Pricing for services is detailed on the Pricing Page or as agreed upon in a separate service proposal. All payments are:

  • Due in full prior to service activation unless otherwise agreed
  • Non-refundable once services have commenced
  • Subject to late fees for overdue invoices (2% monthly interest or max allowed by law)
  • We reserve the right to suspend or terminate services for non-payment.

    5. U.S. Agent and FSVP Agent Limitation of Role

    Our designation as your FDA U.S. Agent or FSVP Agent:

  • Does not make us responsible for your product quality, labeling, or manufacturing practices
  • Does not imply ownership or legal liability over your imported goods
  • Does not replace your obligation to comply with applicable FDA regulations and corrective actions
  • We provide compliance support based on information provided. Any misrepresentation or omission of material information may void our service obligations.

    6. Confidentiality

    We maintain strict confidentiality of all proprietary and business-sensitive information provided to us, except:

  • As required by law or FDA inquiry
  • With your express written consent
  • As part of collaborative compliance management within Consultare Inc. Group and its authorized personnel
  • 7. Intellectual Property

    All materials, templates, training content, and documentation provided by FSVPServices.com are the intellectual property of Consultare Inc. Group and may not be reproduced, shared, or resold without written consent.

    8. Disclaimers

  • FSVPServices.com is not a law firm and does not provide legal advice.
  • Services are provided on a best-effort basis according to current FDA guidelines and client-provided information.
  • We do not guarantee FDA approval, certification, or exemption.
  • 9. Termination

    Either party may terminate service with written notice. Refunds may be issued at our sole discretion based on unused service value. Termination for cause (fraud, non-payment, breach) voids refund eligibility.

    10. Limitation of Liability

    To the fullest extent permitted by law, FSVPServices.com and Consultare Inc. Group shall not be liable for:

  • Indirect or consequential damages
  • Loss of revenue, profits, or data
  • FDA enforcement actions resulting from false or incomplete client submissions

  • Maximum liability shall not exceed the total fees paid for the service in question.

    11. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of laws principles.

    12. Amendments

    We reserve the right to update these Terms at any time. Updated versions will be posted on this page with a revised effective date.
